RoHS Marking and Substance Declaration – Enforcement from January 2026

In a move that brings Taiwan further in line with the EU RoHS Directive (2011/65/EU), BSMI has introduced mandatory RoHS compliance marking for a wide range of electrical and electronic products.

Previously voluntary, the updated rules now require:

  • Declaration of restricted substances (lead, mercury, cadmium, etc.) in accordance with CNS 15663
  • visible RoHS marking (similar to EU “CE + RoHS” labelling) on product or packaging
  • availability of supporting technical documentation upon request

This applies to BSMI-regulated products, including but not limited to:

  • Home appliances
  • Information technology equipment
  • Audio-video electronics
  • Lighting and power supplies

Market Surveillance & Penalties:

Starting 1 January 2026, BSMI will begin random inspections of products in the marketplace.

Non-compliant products may be subject to import rejection, fines, or product recall.

Manufacturers and importers must ensure:

  • Accurate RoHS declarations
  • Updated labelling and manuals
  • Accessible technical files proving substance compliance
