RoHS Marking and Substance Declaration – Enforcement from January 2026
In a move that brings Taiwan further in line with the EU RoHS Directive (2011/65/EU), BSMI has introduced mandatory RoHS compliance marking for a wide range of electrical and electronic products.
Previously voluntary, the updated rules now require:
- Declaration of restricted substances (lead, mercury, cadmium, etc.) in accordance with CNS 15663
- visible RoHS marking (similar to EU “CE + RoHS” labelling) on product or packaging
- availability of supporting technical documentation upon request
This applies to BSMI-regulated products, including but not limited to:
- Home appliances
- Information technology equipment
- Audio-video electronics
- Lighting and power supplies
Market Surveillance & Penalties:
Starting 1 January 2026, BSMI will begin random inspections of products in the marketplace.
Non-compliant products may be subject to import rejection, fines, or product recall.
Manufacturers and importers must ensure:
- Accurate RoHS declarations
- Updated labelling and manuals
- Accessible technical files proving substance compliance
